Terms of Service ImageStamper (referred to as "the site") is a free online tool designed to keep dated copies of license conditions associated with creative commons images (referred to as "the service"). On this site, such copies are referred to as "timestamps", and the act of generating such timestamps is referred to as "timestamping". A timestamp of an image consists of a copy of its internet address (URL), a copy of the image itself and of the associated web page content and the date and time when the timestamp was generated. A timestamp is accessible through the ImageStamper account (referred to as "the account") of the user who requested the timestamp to be created. ImageStamper extracts the above information independently from users, therefore the timestamp of an image is intended to be used as evidence of the image's license conditions at the time of the timestamp's creation. By accessing ImageStamper or using the services offered by ImageStamper you agree to the Terms of Service described herein (referred to as "terms"). If you do not agree to these terms or to our privacy policy (available here), please do not access the site or use the services. ImageStamper reserves the right to change these terms at any time. We recommend that you periodically check this site for changes. 1. Usage License ImageStamper grants you a limited license to access the site and use the services in accordance with these terms and the instructions and guidelines posted on the site. ImageStamper reserves the rights to terminate your license to use the site and services at any time and for any reason or in the future charge for commercial usage. 2. No Warranty and Limitation of Liability IMAGESTAMPER AND ITS OWNERS PROVIDE THE SITE AND SERVICES "AS IS" AND WITHOUT ANY WARRANTY. IMAGESTAMPER AND ITS OWNERS SPECIFICALLY DISCLAIM ANY IMPLIED WARRANTIES OF MERCHENTABILITY, FITNESS FOR ANY PARTICULAR PURPOSE, NON-INFRINGEMENT, INFORMATION ACCURACY, INTEGRATION, INTEROPERABILITY OR QUIET ENJOYMENT. ImageStamper aims to keep the image timestamps that you save to your account for an indefinite period of time in a secure and reliable manner. However, IN NO EVENT SHALL THE SITE OWNERS, CONTRACTORS OR EMPLOYEES BE LIABLE TO YOU OR ANYONE ELSE IN ANY WAY FOR ANYTHING RESULTING FROM OR CONNECTED TO YOUR OR ANYONE'S USE OF THIS WEBSITE, INCLUDING, BUT NOT LIMITED TO 1) ERRORS IN OR LOSS OF INFORMATION STORED BY IMAGESTAMPER 2) MALFUNCTION, INTERRUPTION, UNAVAILABILITY OR DISCONTINUATION OF ANY SERVICES PROVIDED TO YOU BY IMAGESTAMPER 3) COPYRIGHT INFRINGEMENT WITH RESPECT TO ANY IMAGE KEPT ON YOUR BEHALF BY IMAGESTAMPER 4) MALICIOUS UNAUTHORISED ACCESS BY THIRD PARTIES TO YOUR DATA STORED WITH IMAGESTAMPER. Timestamps in your account are intended to be used as evidence that a particular image had a given set of license conditions at the time of the image's timestamp's creation. However,IN NO EVENT SHALL THE OWNERS, CONTRACTORS OR EMPLOYEES OF IMAGESTAMPER BE OBLIGED TO 1) MAKE APPEARANCES OR REPRESENTATIONS ON YOUR OR ANYONE'S BEHALF IN A COURT OF LAW OR ELSEWHERE 2) PROVIDE LEGAL ADVICE TO ANYONE OR 3) PAY ANY COSTS TO ANYONE ARISING FROM A DISPUTE OR TO MAKE ANY MATERIAL CONTRIBUTIONS. In the case of a copyright dispute, assistance from ImageStamper may be provided only on a good-will basis and will not be of a financial nature. ImageStamper and its owners expressly state that they do not claim anywhere on the site that witnessing and storing content with ImageStamper by means of a timestamp provides the same legal value as witnessing and signing the same content by a traditional lawyer or notary. ImageStamper and its owners make no claim about the legal value of the service, and it is up to you to evaluate how it meets your needs. 3. Intellectual Property (Trademarks & Copyrights) ImageStamper retains copies of images you request to be timestamped as evidence of image content. These copies are kept on your behalf and you are fully and solely responsible for observing the copyright requirements of any images that ImageStamper keeps in your account. 4. Other When you request ImageStamper to timestamp an image, ImageStamper acts as a witness of the image content and the image's license. As such, ImageStamper gathers information about the image upon your request, but does so from a location and in a manner that are independent from you. ImageStamper shall not provide a facility for you to modify such information. ImageStamper and you are independent entities, and nothing in the terms, the privacy policy (available here) or via use of the site or services, will create any partnership, joint venture, agency, franchise, sales representative, or employment relationship between ImageStamper and you. These terms supersede any previous agreement and represent the entire agreement between ImageStamper and you. ImageStamper is based in London, England. Nothing in these terms intentionally conflicts with English law. If any provision in these terms is deemed unenforceable, such provision will be severed accordingly, while all other provisions of these terms shall remain in full force.
